Knife Rights Michigan Knife Law Reform Bill Introduced

Michigan State Representative Steven Johnson has once again introduced a bill to remove from Michigan statute all the knives prohibited from concealed carry, HB 4722. Rep. Johnson previously introduced an identical bill last year. Reps. Beau LaFave and Matt Hall are co-sponsors.

HB 4722 would remove Sec. 227. (1) entirely from Michigan’s penal code: “A person shall not carry a dagger, dirk, stiletto, a double-edged nonfolding stabbing instrument of any length, or any other dangerous weapon, except a hunting knife adapted and carried as such, concealed on or about his or her person, or whether concealed or otherwise in any vehicle operated or occupied by the person, except in his or her dwelling house, place of business or on other land possessed by the person.”

In 2017 Knife Rights’ Michigan Switchblade Ban Repeal bill was enacted.

Bass Pro Shops Sells 11 Cabela’s Stores for $324.3 Million

San Francisco — A joint venture led by Sansome Pacific, a real estate investment firm based in San Francisco, has acquired 11 locations of outdoor sports retailer Cabela’s for $324.3 million. The transaction was structured as a sale-leaseback with the seller, Bass Pro Shops, which owns the Cabela’s brand.

Much like Bass Pro Shops, Cabela’s is known for its sprawling retail campuses. The 11-property portfolio spans 1.6 million square feet on 227 acres of land. Bass Pro Shops is based in Springfield, Missouri, while Cabela’s is based in Sidney, Nebraska. The specific locations of the 11 stores were not disclosed. Read more

NY Governor Como Signs Knife Rights’ Bill

Citing “Changing Change in Legal Landscape”  Repealing Gravity Knife Ban

After 9 years of effort, 8 years of costly Federal litigation, 3 bills passed overwhelmingly and the terrifying threat of losing big time at the U.S. Supreme Court (see below), New York Governor Cuomo signed A5944, repealing the state’s bans on Gravity Knives (while leaving the definition intact).

By repealing these bans and making gravity knives legal, New York City and District Attorney Cyrus Vance, Jr., can no longer abuse the definition of a gravity knife and continue to unconstitutionally arrest and prosecute persons by claiming that a common lockblade folding knife or utility knife is an illegal gravity knife. The repeal is effective immediately.

Knife Rights Chairman Doug Ritter said, “After nine years fighting, it is a relief to close the book on this extraordinary abuse of authority by a corrupt system that has terrorized over 70,000 honest, law-abiding people, disproportionately minorities, for simply carrying a common tool used daily in their lives. I am thrilled that we and our partners across the political spectrum in this fight have finally prevailed, but it is a sad commentary on the state of politics and justice in New York State, New York City and at the Second Circuit that it took this long and that tens of thousands of innocent folks had to suffer for the biases held by their elected leaders and the courts.” Read more

Texas: Governor Signs HB 446

Knife Rights supported HB 446,repealing the ban on carry of clubs (including tomahawks) and possession of knuckles (including trench knives and the like) has been signed by Texas Governor Abbot. The new law becomes effective on September 1, 2019.

In 2013 Knife Rights’ repeal of Texas’ switchblade ban was enacted. In 2015 Knife Rights’ signature Knife Law Preemption was enacted, nullifying all local knife ordinances more restrictive than Texas state law, including two of the “10 Worst Anti-Knife Cities in America” at the time, San Antonio and Corpus Christi. In 2017 our bill removed all of the “illegal knives” in Texas law, finally allowing Texans the right to carry a Bowie knife, dagger and others in public. Read more

Knife Rights’ NYC Gravity Knife Case Appeal Headed to U.S. Supreme Court

Knife Rights is going forward with an appeal to the Supreme Court of the United States of the Second Circuit’s decision in favor of New York City and District Attorney Cyrus Vance, Jr. in our long running civil rights lawsuit over their persecution of pocket knife owners.

Justice Ruth Bader Ginsberg last week granted us a 60-day extension until January 13th, 2019, for submission of our petition for a writ of certiorari asking the Court to hear our appeal.

While our lawsuit against New York City and DA Vance centers on their abusive enforcement of New York State’s gravity knife ban against owners of common pocket knives, the focus changes somewhat as it moves to the Supreme Court. Keep in mind that the Supreme Court does not generally agree to hear a case just because any particular decision in a case is unjust, irrational or just plain terrible, all of which describe this ruling in spades. Knife Owners’ Protection Act Introduced in Senate

Senator Roger Wicker (R-MS) has introduced S.3264, the Knife Owners’ Protection Act of 2018 (KOPA) including repeal of the Federal Switchblade Act. This is a companion to the House KOPA bill, H.R.84, introduced last year. Originally conceived and authored by Knife Rights in 2010 and first introduced in 2013, KOPA will remove the irrational restrictions on interstate trade in automatic knives that are legal to one degree or another in 44 states, while also protecting the right of knife owners to travel throughout the U.S. without fear of prosecution under the myriad patchwork of state and local knife laws.

Sen. Wicker said, “I am pleased to introduce the Knife Owners Protection Act. This legislation would provide law-abiding knife owners the appropriate protection when transporting knives across state lines. It would also repeal the antiquated Federal Switchblade Act. I look forward to working with my Senate colleagues to advance this sensible policy for knife owners”

Federal Appeals Panel Upholds NYC Gravity Knife Arrests

On Friday a three judge panel of The United States Court of Appeals for the Second Circuit ruled in favor of New York City and District Attorney Cyrus Vance, Jr. in Knife Rights’ long-running federal civil rights case challenging the City’s policy of treating any locking blade folding knife that can be “flicked” open as a prohibited gravity knife. Knife Rights intends to petition for review of this erroneous decision by the full Court — a process known as en banc review.

In a 45 page decision, the Court failed to focus on the essential constitutional problem with the law — that is, the total inability for anyone to ever determine if a knife they wish to possess is legal. Like the trial court, the Court of Appeals mistakenly focused on the past instead of the key Constitutional Due Process problem faced by folks any time they wish to choose a knife to lawfully possess in the present.

The Court found that the law had, at least once in 2010, been constitutionally applied to Plaintiff Native Leather and that therefore the entire lawsuit had to fail. The Court found that Native Leather did not show that in 2010 its knives responded inconsistently to the wrist flick test and therefore it did not show that that particular application of the law was vague.  But, this approach fundamentally misunderstands the key argument.
