FPC Files Brief to SCOTUS Against “Special Needs Exception” for Gun Seizures

WASHINGTON, DC – Firearms Policy Coalition (FPC) and FPC Action Foundation (FPCAF) today announced the filing of a brief with the Supreme Court in the case of Torcivia v. Suffolk County, which challenges the government’s ability to enter private homes and seize firearms from an individual suspected of no crime, and subject to no penal control or supervision. These seizures, which the Second Circuit categorized as a “special-needs exception” to our Fourth Amendment rights, are a clear violation of our rights and a perversion of justice. The brief can be viewed at FPCLegal.org.

“The Second Circuit’s application of the ‘special needs’ exception—the rejected ‘community caretaking’ exception by another name—would allow many of the home intrusions the founders vehemently opposed, undermining the Constitution and centuries of tradition,” argues the brief. “Its dismissive treatment of the Fourth Amendment is part of a larger trend in which lower courts are undermining the Bill of Rights to avoid protecting firearms and firearm owners.” Read more

CCRKBA: Failed Gun laws, Fear of Crime Bring Record CPL Numbers in Washington

Contact: Alan Gottlieb (425) 454-4911

BELLEVUE, WA – Amid rising violent crime, Washington has reported a stunning number of active Concealed Pistol Licenses issued in a single month; proving that extremist gun control efforts in the Evergreen State have failed miserably and people realize it, the Citizens Committee for the Right to Keep and Bear Arms said today.

New data from the state Department of Licensing shows law enforcement agencies around the state issued 11,292 CPLs in June. This brings the total number of active carry licenses to a whopping 655,709, surpassing the previous record of 650,403 set on April 1, 2020, before the COVID-19 pandemic caused a suspension of CPL application processing. Still, Washington boasts the highest number of resident licenses of any western state.

Two neighboring counties—King and Pierce—account for more than half of all the new licenses. King added 2,504 CPLs and Pierce added 3,605. Over the past three months, Washington has added 18,355 active CPLs.

“Violent crime in Pierce and King counties, combined with a reduction in police manpower has obviously resulted in a predictable public reaction,” said CCRKBA Chairman Alan Gottlieb. “People will protect themselves and their families, and they’re taking that responsibility seriously. These sensible law-abiding citizens realize they are their own first responders. Read more

NSSF Statement on the Bipartisan Safer Communities Act

NEWTOWN, Conn.— NSSF®, the firearm industry trade association, has carefully examined the proposed Bipartisan Safer Communities Act legislation. NSSF appreciates the good faith effort by U.S. Senate negotiators to arrive at a proposal that would meaningfully address criminal violence all too frequently occurring in our communities. NSSF is encouraged by portions of the proposal, but we have important concerns about other aspects of the bill that impact our industry and the Second Amendment rights of law-abiding Americans.

We are thankful the Senate proposal provides significant resources for mental health treatment and services. Most of the horrendous tragedies that have befallen our communities have involved unaddressed mental health issues. We are also heartened the proposal provides necessary resources to help enhance school security to help protect the most vulnerable.

NSSF supports the effort to strengthen federal criminal law to address straw purchasing and firearms trafficking. We have led the effort to stop the illegal straw purchasing firearms and trafficking. For over two decades, NSSF has partnered with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) in the Don’t Lie for the Other Guy™ campaign that helps educate retailers on how to detect and prevent such transactions and to educate the public that it is a serious crime. SAF: High Court Ruling in N.Y. Gun Case Affirms Right to Bear Arms

BELLEVUE, WA – Today’s ruling by the U.S. Supreme Court striking down New York’s “good cause” requirement to obtain a carry permit is a long-overdue affirmation that the right to bear arms exists outside the home, and always has, the Second Amendment Foundation said.

“We are gratified that the high court has said there can be no bureaucratic prerequisite to exercising one’s constitutionally-protected right to bear arms,” said SAF founder and Executive Vice President Alan M. Gottlieb. “For too many generations, New York’s requirement has been the vehicle by which the constitutional rights of average law-abiding citizens have been deprived under color of law.

“Government bureaucrats have routinely been arbitrary and all-too-eager to prevent honest people from having the means to defend themselves against violent crime outside of their homes,” he continued. “This pattern of exclusivity—allowing only those with wealth and political connections to legally carry guns in public—has been an affront to the constitution for decades, and now officials in a handful of other states with similar arbitrary requirements are on notice they can no longer perpetuate what amounts to an outrage against the constitution. We’ll see how this ruling affects eight other states with similar laws including California, Connecticut, Delaware, Hawaii, Maryland, Massachusetts, New Jersey and Rhode Island.” Read more
