Congress Acts on Bad Social Security Measure

After the Senate voted 57-43 yesterday to strike down a Social Security regulation that would have required the Social Security Administration to report anyone who received disability benefits and had a wide range of medical conditions – from serious mental issues to sleeping and eating disorders- mainstream headlines quickly read “Senate Restores Right of Mentally Ill to Purchase Guns”.

It’s a certain sign of just how far the chasm is between fact and objectivity when it comes to supposedly “unbiased” news reports. The measure wasn’t a great piece of legislation artfully crafted to address a glaring need in the existing system. It was a slap-dash piece of legislation. In fact, Sen. Charles Grassley of Iowa, said it was filled with “vague characteristics that do not fit into the federal mentally defective standard” . Those same “vague characteristics” would have lumped people with sleeping disorders into a group of considerably more serious mental issues that would have required the Social Security Administration to notify the FBI of those conditions- so they could be entered into the FBI’s NICS background check system.

In short, it would have guaranteed those people would be denied if they tried to purchase a gun if their conditions led them to have third-party involvement in the management of their affairs.

As Grassley said “If a specific individual is likely to be violent due to the nature of their mental illness, then the government should have to prove it.”
I know it’s not popular with anti-gun folks, but the idea of “innocent until proven guilty” is woven pretty tightly into our national fabric. Read more

Steyr Arms Announces President’s Day Promotion

Boone and Crockett Club Matches NSSF Grant to Montana Council of Boy Scouts of America

MISSOULA, Mont. – Boone and Crockett Club recently matched a $2,000 grant from the National Shooting Sports Foundation (NSSF) awarded to the Montana Council of Boy Scouts of America (BSA). The $4,000 total will be used to help support the shooting sports program at Montana High Adventure Base (MOHAB) and throughout the Montana Council BSA by providing safe and up-to-date equipment.

For the past six years, NSSF has provided funds to local BSA Councils through its BSA Council Challenge Grant program. The grants awarded are to reflect planning to strengthen and increase BSA Council activities in shooting sports and commitment to the advancement of knowledge and understanding of shooting sports activites and firearms safety. The NSSF believes that learning proper skills and safety techniques at an early age often results in a lifetime interest in shooting sports and the outdoors.
This year, NSSF is providing a total of $100,000 to qualifying BSA Councils. Of this amount, the first 50 qualifying grant applicants were eligible to receive up to a maximum of $2,000 in matching grant funding from the NSSF. Boone and Crockett Club stepped in to double that amount with $2,000 to help offset the costs of the local council’s shooting program.
“By being awarded this grant we will be able to very cost-effectively increase the time spent and number of rounds fired at our Palmer Shooting Sports Complex while continuing to teach firearm safety, marksmanship, hunting and shooting sports skills,” said Luke Coccoli, the Club’s conservation programs manager. “The receipt of this grant will undoubtedly benefit the youth that attend our camps and ultimately promote, protect and preserve one of the healthiest pastimes available, shooting sports.” Read more

CGF Seeks Review by Full 9th Circuit Court in Waiting Period Case

SAN FRANCISCO ­­­­­­ – Today, attorneys for The Calguns Foundation (CGF), Second Amendment Foundation, and two individual plaintiffs filed a petition with the Ninth Circuit Court of Appeals seeking en banc (full-court) review of a wrongly-decided opinion that overturned the trial court’s judgment that California’s Waiting Period Laws violate the Second Amendment to the United States Constitution.

CGF Executive Director Brandon Combs, who is also an individual plaintiff in the case, issued the following statement:

In December, the Ninth Circuit Court of Appeals bizarrely ruled that even a person legally carrying a concealed handgun as he buys another gun at retail needs to be ‘cooled off’ for another 10 days before exercising his Second Amendment rights and taking possession of a constitutionally-protected firearm.

We believe that the Ninth Circuit’s panel opinion was wrong as a matter of law. Not only did the panel incorrectly decide the Second Amendment issues in favor of the State of California, but in doing so it ignored important legal rules that govern the review of a lower court’s judgment after a trial.
