Brown Signs California Gun Restraining Order Bill

Yesterday, California Governor Jerry Brown signed into law a measure which allows family members to ask judges to remove firearms from relatives who appear to pose a threat. Prior to the measure’s passage, Connecticut, Indiana and Texas were the only states where law enforcement officials could seek a judge’s order allowing them to seize guns from people they deem to be a danger. The California measure expands the scope by allowing relatives to seek the same restraining orders. Under the bill, whomever seeks the restraining order would be required to sign an affidavit under oath. Falsifying an affidavit is a misdemeanor. A court hearing is mandated within 14 days of the order’s issuance to allow the gun owner a chance to argue they pose no danger. Previously, officials could only seize guns from those convicted of felonies, violent misdemeanors, under a domestic violence restraining order or determined to be mentally unstable.

 

Sam Paredes, executive director of Gun Owners of California says the organization feels the law “just misses the mark and may create a situation where law-abiding gun owners are put in jeopardy.” Brown also signed SB505, a companion measure that will require law enforcement officials to develop policies that encourage officers to search the state’s database of gun purchases as a regular part of routine welfare checks.

DNR reminds deer hunters of changes to license structure

With Michigan’s archery deer season set to begin Oct. 1, the Department of Natural Resources reminds hunters of recent changes to the state’s hunting license structure. 

The new license structure – authorized by the Legislature and signed into law by Gov. Rick Snyder in 2013 – took effect March 1, 2014.  

Among the most significant changes affecting deer hunters, a base license is now required for all hunters. The base license provides critical funding for habitat and conservation work on both public and private land and supports the work of conservation officers and field staff to ensure safe, legal hunting practices are followed. The purchase of a base license includes small game hunting. Whether they choose to hunt small game or not, hunters’ base license dollars will be used to enhance and expand hunting opportunities, which benefits hunters of all species. Read more

Federal Court Ruling Opens Door to Gun Rights Restoration for Certain Misdemeanors

BELLEVUE, WA – The Second Amendment Foundation has quietly won a significant federal court victory in a Pennsylvania case in which the judge has ruled that a man convicted of a serious misdemeanor crime several years ago, but who has demonstrated that he “would present no more threat to the community” than an average law-abiding citizen, may not lose his Second Amendment rights under a federal gun control statute known as 922(g)(1).

The ruling, by Judge James Knoll Gardner for the U.S. District Court for the Eastern District of Pennsylvania, says that application of that statute to the plaintiff, Daniel Binderup, “violates the Second Amendment.”

“This case could provide a building block upon which similar cases in which people are convicted of non-violent misdemeanors might be challenged because they have lost their right to keep and bear arms as a result,” said SAF founder and Executive Vice President Alan Gottlieb. “Under existing federal law, many people convicted of state-level misdemeanors have lost their Second Amendment rights, essentially because they’ve been lumped together with convicted felons.

“One should not lose his or her constitutional rights for certain non-violent indiscretions that occur once in a lifetime,” he added. Read more
