Civil Rights Groups Threaten Philadelphia, Other Cities With 2A Litigation over Tasers, Electronic Arms

SACRAMENTO, CA — Yesterday, attorneys for civil rights advocacy organizations Firearms Policy Coalition (FPC) and Firearms Policy Foundation (FPF) sent legal letters to the cities of Philadelphia, Pennsylvania; Tacoma, Washington; and Wilmington, Delaware demanding that they repeal their respective bans on electronic arms or face federal Second Amendment litigation. Last week, a demand was sent to the City of Westminster, Maryland, regarding its ban.

The Philadelphia Code § 10-825 states that no “person shall own, use, possess, sell or otherwise transfer any ‘stun gun’,” making a violation of the law subject to a fine of up to $300 “and/or imprisonment for not more than ninety (90) days.”

“The Second Amendment to the United States Constitution protects the right to keep and bear arms, not only the right to keep and bear firearms,” explained attorney Stephen D. Stamboulieh in the letters. Read more

Kentucky: Court Fines Man for Illegally Guiding Elk Hunts

FRANKFORT, KY — A Martin County man will pay nearly $8,000 in fines and costs after pleading guilty to multiple counts of illegal guide activities and taking elk.

Byron Delong, 24, of Pilgrim, Ky., pleaded guilty Monday in Martin District Court to guiding elk hunters without a commercial guide’s license, assisting an elk hunter to hunt over bait, and assisting an elk hunter with an At-Large Elk Permit to hunt in a Limited Entry Area.

The court ordered Delong to pay $5,000 in fines, $2,718.36 in restitution for the cow elk taken illegally and $163 in court costs. The court also stripped Delong of hunting privileges for three years and probated his 60-day jail sentence. The court judgment was Martin County’s largest ever handed down for illegal elk hunting and commercial guide services. Read more

Utah: Prairie Dogs Prosper Under State Management

Court ruling gives authority back to the federal government

Cedar City – For more than two years, Utah prairie dogs in southwestern Utah have prospered under the watchful eye of state wildlife biologists.

Now, those biologists are concerned. They say a recent court ruling—which gives management authority back to the federal government—could make it challenging to manage conflicts between prairie dogs and people.

On March 29, the 10th Circuit Court of Appeals overturned a district court ruling made in November 2014. The district court ruling gave management authority—for Utah prairie dogs found on private land—to the state of Utah. The March 29 ruling gives that management authority back to the federal government.

Utah prairie dogs were listed as endangered shortly after the Endangered Species Act was enacted in 1973. Read more

Michigan Constitutional Concealed Carry Bills Introduced

The text for House Bill 4416, the main bill in the constitutional concealed carry package introduced this past week in the Michigan House of Representatives can be found HERE. The bill is straightforward. It simply repeals the requirement to have a license to carry concealed in Michigan. It does not address pistol free zones or registration. We anticipate future bills on those issues this legislative session.

Article 1, Section 6 of the Michigan Constitution states that “Every person has a right to keep and bear arms for the defense of himself and the state.” Currently that constitutional right only protects open carry. A license is required in Michigan to carry concealed. HB 4416 would treat concealed carry the same way open carry is today. Michigan Concealed Pistol Licenses would still be available for those who want them for other reasons such as out-of-state carry with reciprocity, etc.
While MCRGO’s board has yet to take a position on these brand new bills, the board has voted to support the concept of constitutional concealed carry. Despite the “blood in the streets” fears, there is no evidence in states that have already adopted constitutional concealed carry that there has been an increase in the number of unjustified shootings as a percentage of the total number of people carrying outside the home. By helping to increase the number of people carrying legally for self defense, constitutional concealed carry could contribute to fewer violent crimes in our state. Read more

NSSF Commends Reintroduction and Action on Sportsmen’s Act of 2017

The National Shooting Sports Foundation (NSSF), the trade association for the firearms, ammunition, hunting and shooting sports industries, praised the U.S. Senate’s bipartisan reintroduction of S.733, the Sportsmen’s Act of 2017 and the quick action to favorably report it out of the Senate Committee on Energy and Natural Resources. Similar legislation was agreed upon by both the U.S. House of Representatives and Senate late last year, but stalled in a joint House-Senate conference committee. The bipartisan legislative package expands and enhances sportsmen’s access by making federal lands throughout the nation “open unless closed” for fishing, hunting, recreational shooting, and other outdoor activities.

The legislation is sponsored by Sens. Lisa Murkowski (R-Alaska), Martin Heinrich (D-N.M.), both members of the Congressional Sportsmen’s Caucus, along with CSC leaders Sens. Jim Risch (R-Idaho), Joe Manchin (D-W.Va.), Deb Fischer (R-Neb.) and Heidi Heitkamp (D-N.D.).

“The Bipartisan Sportsmen’s Act will help ensure that our nation’s hunting, fishing and shooting traditions are preserved, protected and promoted,” said Lawrence G. Keane, NSSF senior vice president and general counsel. “This legislation addresses many priorities for American hunters, anglers and recreational shooters and its reintroduction in the Senate and immediate committee hearing is representative of the commitment these senators and the Congressional Sportsmen’s Caucus shares for the sportsmen’s community and for America.”

The proposed legislation package would:
•Reauthorize federal lands are “open unless closed” policy for hunting, fishing, and recreational shooting;
•Allow transport of bows and crossbows on National Parks lands;
•Exempt film crews of three or less from commercial filming fees and additional permits;
•Implement the “Hunt Unrestricted on National Treasures” (HUNT) Act, improving access to federal lands for hunting, fishing, and outdoor recreation;
•Increase states’ authority to allocate Pittman-Robertson funds for construction and maintenance of public recreational shooting ranges;
•Permanently establish the Wildlife and Hunting Heritage Conservation Council Advisory Committee to advise the Secretaries of the Interior and Agriculture on wildlife and habitat conservation, hunting, and recreational shooting issues. Read more
