SAF Seeks En Banc Review in New Jersey Sensitive Places Lawsuit

 

BELLEVUE, Wash. —— Attorneys representing the Second Amendment Foundation (SAF) and its partners have filed a petition for en banc review with the Third Circuit Court of Appeals in SAF’s lawsuit challenging New Jersey’s “sensitive places” firearms carry restrictions.

The case, Koons v. Attorney General of New Jersey, challenges the law New Jersey enacted in response to the 2022 landmark Supreme Court Bruen decision, which creates multiple overlapping categories of so-called “sensitive places” where even those with a concealed carry permit are prohibited from carrying a firearm. This patchwork of restrictions created by the challenged law encompasses nearly every square inch of the state and was passed with the express intent of extinguishing the fundamental right to carry a firearm for self-defense.

In September, SAF secured a partial victory in the case when a three-judge panel in the Third Circuit upheld the preliminary injunction SAF won at the district court for the carry of loaded, operable firearms in private vehicles and carry on private property open to the public without the owners express consent or signage. That panel decision did, however, uphold carry bans on public transportation, in public libraries and museums, places where alcohol is served and in entertainment venues.

“Major elements of the panel decision run contrary to both Third Circuit and Supreme Court law in ways which demand review by the entire Third Circuit,” said SAF Director of Legal Operations Bill Sack. “By deriving overly broad generalizations to define what a ‘sensitive place’ actually is under the law, the panel decision improperly bars New Jersey residents from exercising their rights in many of the types of places people go during the course of normal life in a way entirely inconsistent with the demands of the Supreme Court.” Read more

GOA Files Motion for Summary Judgment Against ATF, Challenging NFA Provisions

Tuesday, Gun Owners of America, Inc., Gun Owners Foundation, together with a coalition of plaintiffs including Firearms Regulatory Accountability Coalition, Inc., Silencer Shop Foundation, B&T USA, LLC, Palmetto State Armory, LLC, SilencerCo Weapons Research, LLC, Brady Wetz, and fifteen states led by Texas, filed a motion for summary judgment in the U.S. District Court for the Northern District of Texas.

The motion seeks both a declaratory judgment that certain provisions of the National Firearms Act (NFA) are unconstitutional and an injunction to halt their enforcement as applied to newly “untaxed” firearms—including short-barreled shotguns, short-barreled rifles, silencers, and so-called “any other weapons” (AOWs).

GOA’s coalition of plaintiffs challenged the NFA’s making, transfer, and possession restrictions on these “untaxed” firearms, arguing they are unconstitutional following the passage of the One Big Beautiful Bill Act (Pub. L. No. 119-21) (“OBBB”), which President Donald J. Trump signed into law on July 4, 2025.

Effective January 1, 2026, the OBBB eliminates the NFA’s taxation requirements for these categories of firearms, leaving behind vestigial registration requirements that no longer serve as proof of payment of any tax. As a result, we argued that these excessive regulatory burdens go beyond Congress’s taxing power, cannot be defended under the Commerce Clause, and violate the Second Amendment. Read more

FN Delivers Weapon System Test Samples to DOD’s Irregular Warfare Technical Support Directorate

FN America, LLC is pleased to announce that it has delivered test and evaluation samples of two all-new weapon systems – LICC-IWS and LICC-AMG – along with ammunition as part of a long-term development contract with the Department of Defense’s Irregular Warfare Technical Support Directorate (IWTSD). FN also conducted new equipment training (NET) and armorer’s training for both systems to demonstrate maintenance at the unit level.

FN America developed the weapon systems with feedback from individual operators, based on the U.S. Government goal of providing overmatch against near-peer threats. The systems were recently assigned National Stock Numbers (NSN), simplifying the acquisition process.

The LICC-IWS program is comprised of the 6.5×43 LICC (Lightweight Intermediate Caliber Cartridge) ammunition, the LICC-IWS (Individual Weapon System) with FN® IPC (Improved Performance Carbine), purpose-built magazine and signature suppressor. The LICC-AMG is based on the success of the prototype LICC ammunition and LICC-IWS system and is comprised of the LICC-AMG (Assault Machine Gun) belt-fed machine gun, signature suppressor, family of common ammunition, and lightweight links. Multiple users will test the operational samples , providing critical feedback to aid FN and IWTSD in the final development of the systems.

“FN’s ultimate goal is to advance from development into production and field a final solution that provides operators a system that is easier to operate, more accurate and more effective than anything available today,” said Mark Cherpes, President and CEO for FN America. “After this test and evaluation phase, our plan is to take user feedback, fine-tune the systems and move into low-rate initial production.”

Benzie Road Fire 100% contained; crews still putting out hot spots

The Benzie Road Fire near Houghton Lake in Roscommon County, Michigan, is 100% contained, with fire crews putting water on remaining hot spots near the perimeter on Wednesday.

“They will be out there for the next several days, mopping up to make sure the fire remains contained,” said Jeff Vasher, resource protection manager for the Michigan Department of Natural Resources.

The fire was reported early Sunday afternoon east of Old. U.S. Highway 27 near the Clare-Roscommon county line in a marshy area with mixed conifer and hardwood forest. Resources battling the fire included DNR firefighters, local fire departments, bulldozers, fire engines and drone aircraft support.

The cause of the fire remains under investigation. Read more

Bear Injures Hiker in Fremont County, Idaho

A hiker was injured in a bear attack near Squirrel Creek in Fremont County on Tuesday afternoon, Sept. 30.

The hiker, an adult male, was traveling alone on the South rim of Squirrel Creek when a bear charged at him through the thick timber from a short distance away. The bear bit the man as it ran past him and continued on into the forest. Despite his injuries, the man was able to hike out on his own to seek medical attention.

Fish and Game staff have posted signs in the area advising visitors of bear activity. The bear’s behavior was likely defensive and caused by the surprise, close encounter. Due to the nature of this encounter, no further management actions are planned at this time. Read more

Indiana Visitor Unearths 2.71-carat ‘Hope Diamond’ at Crater of Diamonds State Park

Dewy White of Paoli, Indiana, visited Crater of Diamonds State Park on October 2 and found a beautiful 2.71-carat white diamond.

White and his wife embarked on the road trip of a lifetime with Crater of Diamonds State Park as their first stop. The couple spent two days digging and sifting in the park’s 37.5-acre search area before moving on to their next destination. Having created a lasting memory, the couple revisited the park on their return trip for three more days.

With some screens he had bought on his way into Murfreesboro, White started digging in the Canary Hill area by the south wash pavilion. “A very nice gentleman I met on my first day out here suggested that area,” noted White. “He seemed like he knew what he was doing, and it looked like a nice, shaded spot.”

White spent most of the day dry sifting, a process where dirt is broken up by hand and sifted through mesh screens without water. Getting excited at every piece of quartz and calcite he found, White finally spotted something that looked different than everything he had seen. Read more

Silencer Central, the pioneer of home suppressor delivery, has initiated a lawsuit against FedEx and its subsidiary corporations. Filed October 8, 2025, in the Southern Division of the District Court of South Dakota, the complaint seeks to recover damages caused by FedEx’s alleged negligent misrepresentation and breach of contract.

“I have been discriminated against by big banks for over 20 years because of the type of business I am in, now it looks like common carriers are changing the rules to avoid transporting firearms and accessories.” Having just achieved a landmark reversal from J.P. Morgan Wealth Management regarding discriminatory denial of services, Silencer Central and its CEO Brandon Maddox are fighting back against FedEx to ensure firearm manufacturers and related organizations get fair treatment from one of the nation’s largest courier companies.

“They woke up one morning and decided they didn’t want to ship suppressors,” said Maddox. “Our agreement with FedEx was negotiated over months, key details were confirmed and reconfirmed, and we entered into a major contract in good faith.
