SAF, Grass Roots NC and FPC Sue NC Sheriff Over Pistol Permit Holds

BELLEVUE, WA – The Second Amendment Foundation, Firearms Policy Coalition and Grass Roots North Carolina today filed a federal lawsuit against Wake County, N.C. Sheriff Gerald M. Baker for refusing to accept new applications for pistol purchase permits or concealed handgun permits until April 30, using the COVID-19 outbreak as justification.

The complaint was filed in U.S. District Court for the Eastern District of North Carolina, Western Division. The organizations are joined by Kelly Stafford, a Wake County resident. Plaintiffs are represented by attorneys Ed Green, Raymond M. DiGuiseppe, and Adam Kraut.

“A public health emergency doesn’t suspend or nullify the right to keep and bear arms,” said SAF founder and Executive Vice President Alan M. Gottlieb. “During times of emergency is when a citizen needs the ability to obtain the means of self-defense, and Sheriff Baker’s decision stands directly in the way of that.” Read more

Gun Groups Sue Cal. Gov, LA Sheriff

BELLEVUE, WA – Four leading gun rights organizations today filed a lawsuit in federal court against California Gov. Gavin Newsom and Los Angeles County Sheriff Alex Villanueva, alleging both state and local policies and enforcement practices violate the Second and Fourteenth Amendment rights of their citizens.

Joining in the lawsuit are the Second Amendment Foundation, National Rifle Association, California Gun Rights Foundation and Firearms Policy Coalition. The complaint was filed in U.S. District Court for the Central District of California. A copy of the complaint may be read here.

Burn permits suspended across Michigan due to COVID-19

In response to the “Stay Home, Stay Safe” Executive Order to reduce the effects of the COVID-19 virus, permits for open burning will be suspended across the state. Gov. Gretchen Whitmer issued the order Monday, aimed at further protecting public health and safety.

“We need to make sure our emergency response resources are available where they are needed at this time,” said Dan Laux, fire supervisor for the DNR Forest Resources Division. “Less open burning means less potential for escaped fires, and that means staff can deal with other, more critical needs.”

Because firefighters often work closely together on scene and when traveling to and from incident locations, the suspension of burn permits also will help protect first responders and fire fighters from infection by the novel coronavirus.

“It’s out of an abundance of caution that we want to support the statewide effort to fight COVID-19,” Laux said. “Suspending burn permits in much of the state means fewer people will be burning debris – the No. 1 cause of wildfires in Michigan.”

State Fire Marshal Kevin Sehlmeyer agreed, adding: “This preventative approach to limiting wildland fires is important so that first responders can continue making medical calls during this health crisis.”

Open burning in some parts of the state may still be allowed in areas where the ground is still snow-covered.

Burn permits in the southern Lower Peninsula are issued by local fire departments and governmental offices. In the northern Lower Peninsula and the Upper Peninsula, permits are issued through the DNR’s website Michigan.gov/BurnPermit. Residents are encouraged to frequently check the website to see when restrictions are lifted.

Brian Murphy Resigns as CEO of QDMA

ATHENS, GA (– The Quality Deer Management Association (QDMA) announced today that Brian Murphy has resigned from his position as CEO effective immediately. Murphy had on March 3 announced his intention to transition from CEO to a part-time role after 23 years with the organization to travel and spend more time with his family, and a search for his replacement is already underway.

In the interim, the QDMA Board of Directors has empowered a group of five department leaders to temporarily handle executive functions of the organization. The leadership team includes Director of Finance & Administration April Robertson, Director of Conservation Kip Adams, Director of Communications Lindsay Thomas Jr., Assistant Director of Conservation Matt Ross, and Assistant Director of Hunting Heritage Programs Hank Forester. They will be working closely with Board Chairman Rick Dahl until a new CEO is named.

“I’ve decided it is best for QDMA, me and my family for me to pass the torch sooner and give staff leaders the freedom to implement new strategies to address new challenges,” said Murphy. “I am confident in each of them and their ability to work as a team, continue pursuing the QDMA mission, and assist in the selection of the new CEO.” Read more

Federal Judge Declines Ruling, Sets Briefing Schedule in 2AF v New Jersey

Federal District Judge Michael A. Shipp met with both sides in the Second Amendment Foundation’s lawsuit challenging New Jersey Governor Phil Murphy’s order shutting down firearms dealers in the Garden State. In Kashinsky v. Murphy, the SAF is joined by the New Jersey Second Amendment Society in alleging violation of “civil rights under color of law” by shutting down firearms dealerships, preventing citizens and businesses from exercising their rights under the Second and Fourteenth Amendments. The Second Amendment Foundation’s Alan Gottlieb tells The Outdoor Wire Digital Network that Judge Shipp has set Friday, April 3 as the date for the state’s opposition brief to the suit with the SAF/NJSAS response four days later, Tuesday, April 4.

It’s getting down to crunch time to prepare for cavity nesting birds, and we’ve been emphasizing that aspect of birding recently in advance of this year’s nesting season. The downward curve in our continental bird populations means we all need to make an extra effort this year to make sure our surviving birds prosper and increase for years to come. Some of our favorite backyard birds are cavity nesters, including bluebirds, wrens, chickadees, and screech owls.
