Revising the Endangered Species Act

The intent of the Endangered Species Act (ESA) of 1973 was to protect critically imperiled species from extinction. Administered by two federal agencies – the United States Fish and Wildlife Service (FWS) and the Commerce Department’s National Marine Fisheries Service – it’s been manipulated and perverted to the point that some officials in Congress are pushing for change. That very notion has ruffled some feathers.

Sen. John Barrasso (R-Wyoming) has proposed draft legislation that would amend the ESA potentially providing states greater authority to address struggling wildlife issues within their borders. However, taking any controls out of the hands of D.C. bureaucrats is a tall order. However, but who is prepared better to analyze, restructure, and implement change than the people on the front lines – those whose very living depends on such successes? Rather than drastic measures foisted upon citizens that, in effect, are never-ending, a more sensible approach would be more proactive measures to avoid the perils of listing in the first place.

“We must do more than just keep listed species on life support,” Barrasso said in a recent statement on the bill. “We need to see them recovered.” Amen. But, we also need to be able to define the term “recovered” and to allow states to manage wildlife in a way that is sustainable. Of course, funding mechanisms must be returned to the states or else any mandates would be worth only the paper upon which they are written.

The ESA has often led to a heavily burdened U.S. Fish and Wildlife Service and a host of species that end up in the courts with activist judges pushing agendas that have no basis in science-based outcomes.

During the 2008 presidential campaign, President Obama described the types of judges that he would nominate to the federal bench as follows: “We need somebody who’s got the heart, the empathy, to recognize what it’s like to be a young teenage mom – the empathy to understand what it’s like to be poor, or African-American, or gay, or disabled, or old. And that’s the criteria by which I’m going to be selecting my judges.” Presto! We get one Beryl A. Howell as the chief judge of the United States District Court for the District of Columbia who not only previously said protecting our border is racist but ordered the Western Great Lakes wolves to be reinstated to ESA listing, despite the fact that they had fully recovered for over 10 years!

Now other animal-rights groups want to manage our Lake Sturgeon by placing them on the ESA in an effort to stop our citizens from fishing for them. Never mind that our Michigan DNR has a viable plan in place and has been working this plan for years in a successful endeavor to bring them back. Oh, and the funding? Just thank a fisherman or woman who buys the licenses. That’s sustainable use, my friends.

U.S. Sen. Lisa Murkowski, (R-Alaska), released a statement on recent proposals by the Department of the Interior to address longstanding issues with the ESA, as follows:
“These proposals are another step toward establishing a regulatory environment that will allow the responsible use of our public lands and produce better outcomes for fish and wildlife,” Murkowski, chairman of the Senate Committee on Energy and Natural Resources, said. “In Alaska, we have seen firsthand how the arbitrary application of these laws can foster uncertainty and hamper economic opportunities without delivering the promised environmental benefits”.

The FWS’s proposal would ensure that all threatened species would receive the level of protection that is appropriate for each species. This approach would free-up limited resources for more targeted and efficient recovery of threatened and endangered species. Meanwhile, the proposed rules for the ESA were published recently in the Federal Register, opening a 60-day public comment period.

Michigan DNR firefighters help fight wildland blazes in California and across the nation

More than a dozen wildland firefighters from the Michigan Department of Natural Resources have been sent to California, Oregon, Washington and elsewhere to battle wildfires and to gain valuable firefighting experience.

A crew of three firefighters has taken a DNR fire engine to help fight the vast and still raging Carr fire in northern California, said Dan Laux, fire section manager for the DNR’s Forest Resources Division. Laux just returned from a two-week fire assignment in Portland, Oregon, mobilizing resources to battle fires in Oregon, Washington, California and Idaho.

“We’re mobilizing as many people as we can to assist wherever necessary,” Laux said. “It’s a great way for our folks to get experience, while providing their own skills and experiences to the situation at hand.”

Assistance agreements go both ways. If a significant fire occurs in Michigan, firefighters from other states and Canadian provinces can be tapped for help. Michigan’s largest recent fire was the Duck Lake blaze in the eastern Upper Peninsula, which burned more than 21,000 acres in 2012. Read more

NMMA Opposes Year-Round E15 Fuel Sales

Last week, President Trump announced that he is “very close” to allowing the sale of 15 percent ethanol blended fuel, or E15, year-round. NMMA has worked closely with the administration and Congress regarding the recreational boating industry’s problems with higher ethanol additives in gasoline.

In response, NMMA’s President, Thom Dammrich, stated, “President Trump’s pledge to allow the year-round sale of E15 will needlessly put consumers in danger, including the 142 million American boaters that take to the water every year. There’s a reason that previous proposals to expand the sale of E15 have failed – it’s simply bad policy.”

Dammrich continued, “Unfortunately, most consumers don’t know about the risks of high-ethanol fuel blends like E15 and expanding sales into the summer months will only do more harm. Sixty-five percent of people assume that any gas sold at retail gas stations is safe for all their products, when in fact federal regulation prohibits E15 use in small engines. These engines – like those in boats, lawn mowers, and motorcycles – suffer immediate damage when fueled with blends exceeding 10 percent ethanol, thus voiding their warrantees and saddling consumers with high repair and replacement costs. Michigan: apply for antlerless deer licenses by Aug. 15

Some areas of the state have a limited number of antlerless deer license applications available, making applying for that deer management unit important for some. Private-land applications do require a landowner phone number, so have it ready!

Private-land applications are not needed for chronic wasting disease (CWD) areas, such as DMU 033, 041 and 062. These  licenses will be available without application beginning Sept. 10 at 10 a.m. See antlerless deer license quotas for the complete list of CWD areas.

Young hunters, 16 and under, can buy antlerless deer licenses over the counter through Aug. 15.

Michigan: waterfowl reserved hunt applications now available

Reserved waterfowl hunt applications are available now through Tuesday, Aug. 28.

To apply for reserved hunts on certain managed waterfowl areas, visit a license agent or michigan.gov/waterfowl. Applications are $5, and hunters may only apply once. Drawing results will be posted Sept. 17.

Reserved hunts will be held both mornings and afternoons of the opening weekend (Oct. 13 and 14) of waterfowl hunting season at Fish Point State Wildlife Area, Harsens Island and Shiawassee River State Game Area.

The maximum party size is four hunters. For morning hunts and the second-day hunts, successful applicants must have appropriate licenses and stamps and be accompanied by one to three other appropriately licensed hunters. Youth have a special opportunity because the opening-day afternoon hunts are for those 16 and younger. Successful applicants for the opening-day afternoon hunts can have up to two adults who are 18 years of age or older with appropriate licenses. Read more
