Judge Approves Settlement to Protect Farmers’ Privacy

WASHINGTON — The American Farm Bureau Federation and the National Pork Producers Council yesterday closed the final chapter of their lawsuit challenging EPA’s release of farmer and rancher personal information, when a federal judge approved a settlement that secures the private information of thousands of livestock and poultry farmers in 36 states.

“This lawsuit has won a major victory for personal privacy,” said American Farm Bureau Federation President Zippy Duvall. “Months ago, we won a court decision that vindicates the rights of farmers and all Americans to protect their personal information from dissemination by the government. This settlement is the final step, requiring that EPA scrub all personal information from the records involved and train its staff on the proper handling of personal information.” Read more

Arizona GFD Wildlife Assets to Be Auctioned at Outdoor Expo This Weekend


Antlers, hides, head mounts and more will be in high demandPHOENIX —The Arizona Game and Fish Department will auction its annual collection of wildlife assets March 25-26 during the 2017 Outdoor Expo at the Ben Avery Shooting Facility, just west of Interstate 17 on Carefree Highway. Admission and parking are free.

More than 100 sets of antlers, hides, skulls and head mounts, as well as wildlife artwork and taxidermy – all seized during law enforcement investigations, obtained from animals killed in vehicle collisions, or acquired through donations — will be sold. Items can be purchased individually, by the pound or through a silent auction.

While a detailed list of assets is unavailable at this time, the department soon will be posting photos on Instagram (www.instagram.com/gf_assets) as examples of some of the individual items that will be auctioned during the two-day sale. Once the expo gets underway, photos of many of the assets will be posted for the benefit of those tracking their bids or wanting to see what items become available throughout the day. Read more

Legal FAQ:  Use of Deadly Force in Michigan

This past week, MLive covered several cases of potential unjustified shootings in Michigan by otherwise legal gun owners.  This has led many people to ask us at Michigan Coalition of Responsible Gun Owners (MCRGO) when they may use a firearm in self defense.  The relevant section in Michigan law is MCL 780.972.  It reads:
780.972 Use of deadly force by individual not engaged in commission of crime; conditions.

Sec. 2.
(1) An individual who has not or is not engaged in the commission of a crime at the time he or she uses deadly force may use deadly force against another individual anywhere he or she has the legal right to be with no duty to retreat if either of the following applies:
(a) The individual honestly and reasonably believes that the use of deadly force is necessary to prevent the imminent death of or imminent great bodily harm to himself or herself or to another individual.
(b) The individual honestly and reasonably believes that the use of deadly force is necessary to prevent the imminent sexual assault of himself or herself or of another individual.
(2) An individual who has not or is not engaged in the commission of a crime at the time he or she uses force other than deadly force may use force other than deadly force against another individual anywhere he or she has the legal right to be with no duty to retreat if he or she honestly and reasonably believes that the use of that force is necessary to defend himself or herself or another individual from the imminent unlawful use of force by another individual.

Ninth Circuit Panel Maintains Suspension of Executive Order on Immigration

A three-judge federal appeals court in the U.S. Circuit Court of Appeals for the 9th Circuit Court has upheld the earlier ruling of U.S. District Judge James Robart that put President Trump’s temporary travel ban on hold. The Justice Department now has the option to ask the Supreme Court to intervene. Should the ideologically divided Supreme Court find itself unable to reach a majority decision, however, the 9th Circuit’s ruling would remain in place.

DNR conservation officer rescues runaway boy from Lake Michigan ice in Delta County

Michigan Department of Natural Resources Conservation Officer Patrick Hartsig rescued a 10-year-old boy Sunday, who had run away from his family near Gladstone in Delta County.

The incident was reported at about 4 p.m. The boy, whose name was not being released, had run away from the Log Cabin Grill and Bar, which is situated south of Gladstone, along Lake Michigan.

To reach the lake, the boy had cross four busy lanes of traffic on U.S.-2. His mother last saw him heading east across the ice.

Hartsig had been working snowmobile patrol in adjacent Alger County.

“On my way home, I heard a call on Delta dispatch of a runaway special needs boy that was somewhere south of Gladstone, on the ice on Little Bay de Noc,” Hartsig said. “I checked in with dispatch as I was near Hunter’s Point and launched my sled.” Read more
