Michigan Senate Judiciary Committee to Consider Repeal of Permit to Purchase and Gun Registration on Wednesday

This Wednesday, July 18, the Michigan Senate Judiciary Committee will hold a special hearing on legislation to repeal Michigan’s “permit-to-purchase” and registration requirements for handguns.  House Bill 5225, which seeks to replace the state handgun “permit-to-purchase” requirement with the FBI’s National Instant Criminal Background Check System, has already passed in the state House of Representatives by an overwhelming 74 to 36 vote on June 13.  Additionally, the Senate Judiciary Committee will hear the two companion bills to HB 5225,  House Bill 5498 and House Bill 5499, both of which also passed the state House and were sent to the Senate last month. Oral Arguments Presented in Illinois Right-to-Carry Case

In perhaps the clearest case in the country addressing the right to bear arms outside the home for self-defense, oral arguments took place June 8 in Chicago, before the United States Court of Appeals for the Seventh Circuit. Shepard v. Madigan involves lead plaintiff Mary Shepard, an Illinois resident and trained gun owner with no criminal record, who is licensed to carry a concealed handgun in both Utah and Florida.  Unfortunately, she has no legal way to do so in Illinois as soon as she steps away from her home or place of business.  The National Rifle Association is funding this case, and our state affiliate, the Illinois State Rifle Association, is a co-plaintiff on behalf of its members who share Mrs. Shepard’s plight. Michigan Firearms Legislation Update

House Bill 5225 H-4 passed the full Michigan House of Representatives on Wednesday, June 13 on a vote of 74-36 along with companion legislation HB 5498 and HB 5499.  These bills repeal the permit to purchase process and registration requirements for pistols in Michigan.  MCRGO actively supports these bills and has been laying the groundwork for the repeal of mandatory registration over the past five years.

NICS checks would remain in place for FFL dealers.  The legislation would require state and local police agencies to destroy their pistol registries within six months following the effective date of the new law.  Michigan is currently one of a very small minority of states that maintain mandatory state registration.  The federal government is legally prohibited from maintaining a national pistol registry.

The Michigan Legislature began its summer recess on Friday, June 15.  The bills are expected to be taken up by the Michigan Senate this fall.

Michigan House Votes Overwhelmingly to Repeal Permit-to-Purchase and Registration

Yesterday, the Michigan House of Representatives voted overwhelmingly to repeal the state handgun “permit-to-purchase” and registration requirements.  House Bill   5225 passed in the state House by a 74 to 36 vote.  HB 5225 would repeal the bureaucratic state “permit-to-purchase” handguns and instead utilize the FBI’s National Instant Criminal Background Check System.  House Bill 5498 and House Bill 5499 also passed in the state House along with HB 5225.  These three bills now go to the state Senate where they will be assigned to the appropriate   committees.
