Judge Grants Summary Judgement Against California Law Denying Restored Gun Rights

BELLEVUE, WA – A federal judge in California has granted summary judgment to three individuals in a lawsuit challenging that state’s Penal Code which permanently denies Second Amendment rights to people who have had felony convictions vacated, set aside or dismissed, and their rights to possess firearms fully restored. The case is known as Linton v. Bonta.

U.S. District Judge James Donato in the Northern District of California wrote, “After multiple hearings and several rounds of briefing, and in light of the guidance provided by New York State Rifle & Pistol Association, Inc. v. Bruen…the Court concludes that California has violated the Second Amendment rights of the individual plaintiffs. Consequently, summary judgment is granted in favor of (Chad) Linton, (Paul McKinley) Stewart, and (Kendall) Jones on their as applied Second Amendment claim.”

The case was originally filed in December 2018. They are represented by attorney George Lee of Seiler Epstein, LLP in San Francisco. The challenge was originally brought by SAF, the Calguns Foundation, Madison Society Foundation, Firearms Policy Coalition and Firearms Policy Foundation and the three individuals. In his opinion, Judge Donato dismissed all the institutional plaintiffs. SAF continues to support the case.

According to SAF Executive Director Adam Kraut, “The three individual plaintiffs were all convicted of non-violent felonies in other states decades ago. None of the convictions involved a weapon, drugs, or violence, in the ordinary meaning of the word. Each of the plaintiffs had their conviction vacated, set aside, or dismissed, and their right to possess firearms restored by the jurisdiction in which they were convicted. Linton legally acquired firearms in California on prior occasions, and Jones was a career law enforcement officer in California with special training and certification as a firearms instructor. Even so, California acted to permanently deny them of the right to possess or own firearms, solely on the basis of their original convictions.” Read more

Army Tests New Rifle, Automatic Rifle in Extreme Weather

Soldiers at the Cold Regions Test Center in Fort Greely, Alaska, where temperatures dipped to 35 degrees below zero last month, tested the Next Generation Squad Weapon (NGSW) XM7 rifle and XM250 automatic rifle in various mission-oriented tasks under conditions one might experience in the Arctic.

Testing began in earnest in late January after a week of foundational new equipment training to familiarize the Soldiers with the weapons, which will be fielded, beginning this year, to members of the Close Combat Force, which includes infantry Soldiers, cavalry scouts, combat engineers, forward observers and combat medics.

The NGSW system includes the two weapons, an advanced fire control and a 6.8 mm family of ammunition.

The NGSW team, which comprises the Soldier Lethality Cross-Functional Team (SL CFT), Program Executive Office Soldier, Joint Program Executive Office Armaments & Ammunition and industry partners, worked with a team from the Army Test and Evaluation Command to see how the extreme cold might affect the performance of the weapons, the ammunition, the fire control and power supplies.

Testing wrapped up Feb. 9, and results will be made available to Army senior leaders soon. Read more

Actor and Author Capt. Dale A. Dye Returns to the Black Sands of Iwo Jima for The Armory Life

Help Stop Invasive Species During National Invasive Species Awareness Week

National Invasive Species Awareness Week is an international annual event held February 26 through March 3, 2024, looking to raise awareness about invasive species, the threat they pose, and what can do together to prevent their spread. In support of NISAW, the Michigan Department of Agriculture and Rural Development is encouraging all Michiganders to do their part to prevent the spread of invasive species.

Invasive species are plants, animals, insects, and pathogens not native to an area and can cause serious harm to the environment, economy, agriculture, or public health. These pests often are fast growing, reproduce rapidly, and have few predators or natural controls in their new environments.

“Our department works tirelessly to prevent the spread of these pests, but getting everyone involved in prevention and detection is key to the fight against invasive species,” said Steve Carlson, MDARD’s Pesticide and Plant Pest Management Division Director.
