NSSF Wins Preliminary Injunction Against California’s Unconstitutional Law Allowing Frivolous Lawsuits Against Firearm Industry

NSSF®, The Firearm Industry Trade Association, applauded the decision by U.S. District Judge Andrew Schopler granting an injunction prohibiting the enforcement of California’s law that exposes firearm industry members to lawsuits in California for the lawful commerce in firearms that takes place entirely outside the state of California when those legally made and sold products end up being misused by criminals and others in California.

The ruling by Judge Schopler in the U.S. District Court of the Southern District of California enjoined the enforcement of California AB 1594, the so-called “Firearm Industry Responsibility Act.” NSSF sued to challenge the law in June of 2023 and moved for an injunction. In granting the injunction, Judge Schopler found the law is likely unconstitutional because it violates the Commerce Clause.

“We are thankful the court enjoined the state from suing members of the firearm industry under this unconstitutional law that attempts to use the real threat of liability on commerce beyond California’s borders and impose its policy choices on its Sister states,” stated NSSF Senior Vice President and General Counsel Lawrence G. Keane.

Among other provisions, California AB 1594 bans the manufacture, sale and marketing of firearms the state deems “abnormally dangerous.” It allows civil lawsuits against a firearm industry member to be filed by the Attorney General, any municipality and any person who claims to have suffered harm from the misuse of a legal, lawfully sold firearm by a remote third party. The law unconstitutionally invades the sovereignty of sister States by directly regulating lawful commerce occurring entirely outside the state of California in violation of the Commerce Clause and the United States’ system of federalism. The law also violates the Protection of Lawful Commerce in Arms Act (PLCAA) enacted by Congress in 2005 to stop just these sorts of frivolous lawsuits against members of the industry.

Keane added, “We are reviewing the balance of the court’s decision and whether we will file an amended complaint to provide the court more details on how California’s unconstitutional law and its threat of crushing liability is causing real and ongoing harm to members of our industry.”

NSSF also claims in its lawsuit that the law also infringes on the Second Amendment and chills First Amendment rights by restricting protected free-speech advertising of Constitutionally-protected products that are lawfully made and sold – even when that advertising takes place outside of California’s borders. Wild Turkey Capture Attempts Begin in Southeast

Wild turkey genetics, nesting success, and brood survival are among the research topics in a 4.5-year, $2 million study launched in 2022 by the Oklahoma Department of Wildlife Conservation, the Oklahoma Cooperative Fish and Wildlife Research Unit, with cooperation from the National Wild Turkey Federation, Turkeys for Tomorrow, and private landowners to address wild turkey population dynamics. Following is a summary of recent study activities.

SOUTHWESTERN OKLAHOMA POPULATION STUDY AREA: Preparations for winter captures continued. Researchers began baiting and constructing traps at one site in Beckham County and one site in Harmon County. They also coordinated with cooperators in Custer County to begin baiting and monitoring future trap locations there. Data download from remaining hens from last year continued during January.

SOUTHEASTERN OKLAHOMA POPULATION STUDY AREA: Preparations for winter captures continued. Researchers scouted and baited many different sites across McCurtain County and attempted captures on one mixed flock that was inconsistent on camera and only included three hens. Researchers reported three groups of hens seen on cameras visiting bait sites.

GENETICS STUDY: Genomic data has been cleaned and quality-controlled for the initial 220 samples collected from the 2022 and 2023 seasons. For analyses, 163 samples from Oklahoma were selected and further separated into subspecies-specific datasets according to current ODWC designation of subspecies and hybrid zones by geographic location.

Initial data processing involved quality control steps to remove low-quality data, reduce errors, and facilitate reproducibility of results. Read more

GOA, GOF File Petition with SCOTUS in NY Concealed Carry Lawsuit

Gun Owners of America (GOA) and Gun Owners Foundation (GOF) petitioned for writ of certiorari to the U.S. Supreme Court in their challenge to New York’s mistakenly named “Concealed Carry Improvement Act.”

This sweeping law was passed in Albany after the Supreme Court rebuked the state’s may-issue concealed carry permitting scheme. But frustratingly, this new statute is more onerous and restrictive than the one overturned in the Bruen decision.

GOA quickly challenged this new law after its passage in federal court, where Judge Glenn Suddaby repeatedly sided with GOA by blocking several of its major provisions. Frustratingly, the Second Circuit Court of Appeals was eager to intervene on behalf of anti-gunners, keeping much of the challenged law in place, which has led to today’s filing with the Supreme Court.

The law’s provisions that are still in effect require applicants for a concealed carry license to:

    • Display “good moral character”
    • Have in person interviews with law enforcement
    • Provide four “character references”
    • Undergo 18 hours of combined training, a tremendous increase from the existing 4-hour requirement

CMP Offers Long Range Rifle Match at Camp Perry in June – Featuring Electronic Targets

The Civilian Marksmanship Program (CMP) will host a Long Range Rifle Match, June 29-30, 2024, at Camp Perry in Ohio. Rifle categories offered during the event include Match (Any and Iron Sights), Service, Palma, AR Tactical, F-Open and F T/R. The event is open to any adult or junior with a Long Range rifle, regardless of experience.

“We’re trying to add Long Range opportunities to as many events as possible, with the hopes of growing our program and bringing new competitors and Long Range interest to the CMP,” said Sara Rozanski, CMP highpower rifle coordinator.

For the first time, the 1,000-yard event will be fired on CMP’s line of outdoor electronic targets. The targets include monitors at each firing point that instantly display accurate shot scores, creating a more leisurely experience for individuals on the firing line.

“We would like to start using our line of electronic targets for the annual National Long Range events at Camp Perry in the near future, and these smaller matches are a great way to slowly work out any issues we may encounter,” Rozanski added. “With the addition of electronic targets, we’re hoping to encourage more individuals to give Long Range a try.” Read more

Late Winter Mallard Estimates Remain Lowest in 15 Years

In the final aerial survey of the 2023-24 waterfowl season, Arkansas Game and Fish Commission biologists estimated a Delta mallard population that was more than a half-million mallards below the 2009-2024 late January long-term average and the lowest late January survey estimate on record since the 2010 start of transect-based surveys. Also, total duck population estimates were nearly 480,000 birds below the long-term average, largely due to the low number of mallards.

On average, mallards account for about 55 percent of all ducks in the Delta during late January surveys. During this survey period, however, mallards made up only 33 percent of the total duck estimate. Read more
