SAF: New ‘Background Check’ Rule Another Step in Biden’s War on Guns

The rule… is almost certain to be challenged in federal court.

The Biden administration’s new rule to expand background check requirements for private gun sales amounts to another attack on America’s gun owners, the Second Amendment Foundation said in response.

“This is a continuation of the Biden war on guns,” said SAF founder and Executive Vice President Alan M. Gottlieb. “It is another attempt to get around Congress to make new laws without congressional approval.”

The White House contends this rule is intended to close the so-called “gun show loophole” and the related “online sale loophole.”

“The president is claiming this will keep guns out of the hands of felons, and he knows better,” Gottlieb said. “If history has taught us anything, it would be that criminals do not obtain the guns they use through legitimate channels, and that gun control laws have never prevented criminals from obtaining a firearm. All this rule will accomplish is to place yet another burden on honest citizens wanting to exercise their Second Amendment rights.

“Even more troublesome,” added SAF Executive Director Adam Kraut, “is the potential for abuse by Biden’s weaponized ATF against private citizens legally selling their personal firearms collections or family heirlooms.”

Research done by the federal Bureau of Justice Statistics has repeatedly found that gun shows are responsible for less than one percent (0.8%) of guns used by criminals convicted of crimes involving firearms.

The rule takes effect in 30 days. It is almost certain to be challenged in federal court.

The Second Amendment Foundation (saf.org) is the nation’s oldest and largest tax-exempt education, research, publishing and legal action group focusing on the Constitutional right and heritage to privately own and possess firearms. GCA – CMP Master Marksman Program Update

It has now been a year since the GCA and CMP (in a joint partnership) announced the creation of the “Master Marksman Program”. This program was created to motivate GCA members to participate in CMP matches, and to acknowledge those who consistently score well with As-Issued M1 Rifles at designated Civilian Marksmanship Program (CMP) competitions.

Similar to the CMP’s established Distinguished Badge Program, the new Master Marksman Program works on an Achievement Award point system, based on performance at designated CMP events. Points are awarded based on cut scores and presented at gold (10 pts), silver (8 pts) and bronze (6 pts) levels. Competitors must reach a total of 40 points overall, with one gold and one additional gold or silver required. All other points may be bronze or greater.

To participate, a competitor must be a current member of the GCA. Individuals may even join the day of the match through the GCA website to be considered a valid member. Read more

Rabies Incidents A Reminder To Keep Pets Vaccinated

The Arizona Game and Fish Department (AZGFD) reminds the public to protect themselves and their pets by keeping a safe distance from wildlife, especially animals that may be behaving abnormally, such as those that appear overly aggressive and/or lacking a fear of humans.

The reminder comes after a gray fox, suspected of being rabid, bit three people in two separate attacks earlier this month at Saguaro National Park in southern Arizona. The animal was killed as it approached a park service officer. Another gray fox was located and killed last month after it bit a person in a picnic area on Mount Lemmon near Tucson. Read more

SAF “Rebuts AG Ferguson’s Falsehoods About Courts and Magazine Bans”

BELLEVUE, WA –– Washington Attorney General Bob Ferguson is playing fast and loose with the facts when he claims every court across the country has “either rejected or overturned” legal challenges against magazine bans, the Second Amendment Foundation said in response.

“A federal court in California declared that state’s magazine ban to be unconstitutional,” said SAF founder and Executive Vice President Alan M. Gottlieb. “That ruling was stayed, and the order has been appealed to the 9th US Circuit Court of Appeals, but it has yet to be overruled. Washington is in the 9th Circuit.”

Likewise, he noted, Oregon Measure 114—an extremist gun control law passed by voters two years ago, which contained a magazine ban—was also declared unconstitutional by a circuit court judge. That ruling has been appealed to the Oregon Supreme Court, but Gottlieb said the judge’s decision has also not been overruled

“We’re not sure why the media allows Ferguson to get away with such statements without some fact-checking,” Gottlieb questioned. Read more

NSSF Praises U.S. House Passage of EXPLORE Act

NSSF®, The Firearm Industry Trade Association, praises the U.S. House of Representatives’ bipartisan passage of H.R. 6492, the Expanding Public Lands Outdoor Recreation Experiences (EXPLORE) Act. The bill, introduced by U.S. Rep. Bruce Westerman (R-Ark.), garnered 51 bipartisan cosponsors. The measure was approved in a voice vote, a rare demonstration of Congress working across party lines.

The EXPLORE Act must be approved by the U.S. Senate before it can be considered by President Joe Biden.

The NSSF-supported bill includes the Range Access Act, which would increase and improve outdoor recreation opportunities across the nation while improving infrastructure and driving economic growth in rural communities. Specifically, that portion of the bill would require the U.S. Forest Service and Bureau of Land Management (BLM) to have at least one qualifying recreational shooting range in each National Forest and BLM district which is crucial to ensuring safe public recreational shooting.
