SWAROVSKI OPTIK is setting a new milestone in the world of premium compact spotting scopes with the AT/ST Balance. Sportsmen’s Alliance Reviewing Four Proposed Changes to ESA Regulations

The U.S. Fish and Wildlife Service published four proposed rules to restore Endangered Species Act (ESA) regulations to their 2019 and 2020 framework. The service says the rules are designed to provide clarity and predictability to how the ESA is implemented while utilizing “science-based conservation that works hand in hand with America’s energy, agricultural and infrastructure priorities.”

Specifically, the service has proposed rules concerning the procedures and criteria used for listing, reclassifying, and delisting species, and designating critical habitat; reinstating definitions guiding how federal agencies cooperate in carrying out the ESA’s provisions; removing the “blanket rule” option for protecting newly listed threatened species; and revising the criteria used when designating any particular area as critical habitat.

Undoubtedly, the way agencies have implemented, and courts have interpreted, rules and regulations, the ESA has strayed from the act’s original intent. The Sportsmen’s Alliance has engaged in numerous ESA-litigation matters, including multiple ongoing lawsuits regarding the status of gray wolves throughout the United States. Unfortunately, we’re stuck in a cycle of agency action, litigation, new agency action, new litigation, and so on.

While we applaud the service for doing something to steer endangered species policy back onto the tracks laid by the ESA, we’re carefully reviewing and evaluating all four rules to ensure they effectively address necessary fixes to the act’s implementation without placing imperiled species and habitats behind development goals. In addition to commenting on the proposed rules, we’re prepared to enter legal battles that are sure to result from these proposals. Read more

GOA and Gun Owners Foundation Declare DOJ Brief an Open Attack on the Second Amendment and Constitution

The Department of Justice filed an outrageous brief that embraces an alarmingly expansive theory of federal authority. In responding to GOA and GOF’s “One, Big, Beautiful Lawsuit,” the DOJ treats Congress’ removal of the historic $200 tax as a pretext to rewrite the limits of congressional power, advancing an argument that would open the door to federal regulation far beyond anything the Framers intended.

GOA and GOF condemn Attorney General Pam Bondi and President Trump’s Department of Justice (DOJ) for doubling down on enforcement of an archaic and unconstitutional law while simultaneously offering legal theories that would expand federal power to historic levels. This is especially striking from an administration that had promised to respect the Second Amendment and review burdensome agency rules.

The implications of DOJ’s stance are immediate and ominous. If the brief’s logic is accepted, courts could bless a framework under which Congress and federal agencies regulate—or effectively ban—common firearms and accessories by treating formalistic features (like a $0 tax) as sufficient legal cover. That outcome would run contrary to recent Supreme Court statements that the Second Amendment protects private arms possession.

Sportsmen’s Alliance Foundation Enters Hawaii Gun Control Fight

On Nov. 20, the Sportsmen’s Alliance Foundation filed an amicus curiae brief in the Ninth Circuit Court of Appeals challenging two Hawaiian laws that pose undue burdens on gun owners.

Hawaii makes it very difficult for a person to acquire a handgun legally. The law first requires a permit to purchase. To do that, an individual must undergo a background check and provide specific information about the firearm they are purchasing—manufacturer, model, action, caliber, serial number, etc. The law forbids any local law enforcement agency from issuing the permit until 14 days after the application was received but requires it to be issued within 40 days. The permit expires 30 days after it is issued, and if the transaction is not completed in that timeframe, the process starts all over again.

But that is not the end of it. The seller must sign the permit and return it, along with the gun’s identifying information, to their local law enforcement agency within 48 hours. The pain is still not over as the buyer must then bring the firearm to the police station for a physical inspection within five days of completing the sale.

The expiration date on the permit to purchase and the five-day in-person inspection requirement were challenged in federal court under the Second Amendment. The trial court struck them down in 2021. Hawaii appealed, and a three-judge panel of the Ninth Circuit affirmed that the laws were invalid in March of this year. Hawaii then sought en banc review, a process in which 11 judges on the Ninth Circuit will review the three-judge panel’s decision. SAF Files Amicus Urging Supreme Court to Reverse Vampire Rule Decision

The Second Amendment Foundation (SAF) has filed an amicus brief with the U.S. Supreme Court in Wolford v. Lopez, urging the Court to reverse the Ninth Circuit’s decision upholding Hawaii’s infamous “Vampire Rule.”

The Hawaii law, like similar statutes in California, New York and other states, declares virtually all private property open to the public — grocery stores, gas stations, restaurants and more — off-limits for lawful carry unless the property owner gives express permission. The result: permit holders who wish to exercise their Second Amendment rights are effectively banished from most places.

“This is the post-Bruen rebellion in its purest form,” said SAF Director of Legal Research and Education Kostas Moros. “Anti-gun states invented the ‘Vampire Rule’ for the sole purpose of nullifying the right to carry. They are not protecting private property rights – they are deliberately making public carry so burdensome that citizens will simply give up. The Ninth Circuit blessed this transparent end-run around the Second Amendment and only the Supreme Court can stop it.”

SAF is joined in the amicus by the Citizens Committee for the Right to Keep and Bear Arms, Connecticut Citizens Defense League and Minnesota Gun Owners Caucus.

“If the Ninth Circuit’s decision stands, the constitutional right to bear arms in public for self-defense will exist only on paper in large parts of the country,” said SAF founder and Executive Vice President Alan M. Gottlieb. Read more
