Appeals Court Remands Decision for ‘Strict Scrutiny’ of Second Amendment

NEWTOWN, Conn. — The U.S. Court of Appeals for the Fourth Circuit overturned a federal district court decision that had upheld the 2013 State of Maryland Firearm Safety Act as constitutional under intermediate scrutiny review.

Writing for the three-judge appellate court panel that heard the case, Kolbe v. Maryland, Chief Judge William B. Traxler wrote: “In our view, Maryland law implicates the core protection of the Second Amendment — ‘the right of law-abiding responsible citizens to use arms in defense of hearth and home, District of Columbia v. Heller, 554 U.S. 570,635 (2008), and we are compelled by Heller and McDonald v. City of Chicago, 561 U.S. 742 (2010), as well as our own precedent in the wake of these decisions to conclude that the burden is substantial and strict scrutiny is the applicable standard or review for Plaintiffs’ Second Amendment claim.” Read more

New legislation would allow concealed carry without a permit in Michigan

Legislation recently introduced by four House Republicans in Michigan would allow law-abiding citizens to carry concealed weapons without a government-issued permit.

The bills’ sponsors indicate penalties for unlawful possession of a firearm will remain in effect, and people who are currently not legally allowed to carry firearms will not be allowed to carry a concealed weapon legally either.

Supporters say requiring a special permit forces inefficient spending, and is an inconvenience to gun owners.

CCRKBA To Seattle, Chicago: “How Are Those Gun Taxes Working For You?”

BELLEVUE, WA – Following the bloodiest January in Chicago in 16 years, a double homicide Jan. 26 in Seattle’s “Jungle” homeless camp and Wednesday’s shooting on a Metro bus, the Citizens Committee for the Right to Keep and Bear Arms is challenging both anti-gun cities to explain how their gun violence taxes have accomplished anything to reduce firearms-related violent crime.

At the same time, CCRKBA Chairman Alan Gottlieb also wants the backers of Initiative 594, passed 15 months ago in Washington state as a so-called “universal background check” gun control measure, to explain why their new law has failed to prevent teens and public transit gunmen from committing heinous acts. There have been no arrests or prosecutions under 594 despite claims that it has prevented more than 100 illegal purchases, he noted.

“Chicago’s body count for January was 51 dead and a lot more wounded,” Gottlieb observed. “Seattle is off to a rousing start as well with the double-murder at ‘The Jungle’ under I-5 and yesterday’s bus shooting. And let’s not overlook the other double homicide last month in which the victims were beaten to death, a crime that proves restrictive gun laws don’t stop murders because killers will find other ways to commit mayhem.”

Noting that the teenage suspects in the fatal Seattle shooting couldn’t legally carry or possess handguns, Gottlieb said this incident offers yet more evidence that I-594 was just “one more false promise of gun control.” There was no background check conducted in the acquisition of the guns allegedly carried by the teen suspects, and he noted that a police drug raid Tuesday in Burien turned up a stolen gun, which also wound up in the wrong hands, and “definitely no background check was conducted there,” he added.

Both the gun control initiative and the Seattle gun tax are being challenged in court, and a lawsuit has also been brought against the gun tax in Cook County, Illinois, which encompasses Chicago.

“Anti-gunners in Seattle and Chicago need to acknowledge that their gun control efforts aren’t part of the solution to violence, they’re part of the problem,” Gottlieb said. “They are pushed with lots of promise, but they’re quickly revealed to be all flash and no substance. They penalize honest citizens and don’t impress criminals. They lie, and people still die.” Read more

Wayne LaPierre Issues a Challenge for the President


FAIRFAX, Va. – In a video response to President Barack Obama’s town hall on gun violence, National Rifle Association Executive Vice President and Chief Executive Officer Wayne LaPierre invites the president to a one-on-one, one-hour debate with a mutually agreed-upon moderator. “No pre-screened questions and no gas-bag answers,” says LaPierre.The video is the latest in a series of commentaries by the NRA leader airing on NRANews.com. LaPierre notes that seven years ago, Obama set out to fundamentally transform our country. And he says that’s exactly what happened: “When it comes to the runaway power of the executive branch over Congress, the courts, the people and the rule of law … the president has laid waste to the America we remember.”

He goes on to say that the president has chosen to attack what he misunderstands most about America—the Second Amendment, gun owners and the NRA. Obama, LaPierre points out, even announced a federal gun force that will be four times the size of the Special Forces units he deployed against ISIS terrorists. Americans don’t trust the president, LaPierre says, because he’s proven to be unworthy of our trust. He warns that Obama’s calculation is clear—to destroy the NRA before the election, so Hillary Clinton can destroy the Second Amendment after it.

LaPierre concludes the video with an open invitation to the president to meet for a fair debate: “It’s your chance to show the American people you’re not afraid to meet the NRA on neutral ground.”

Obama and guns: Eleven false or misleading claims

GW:  I knew it when I heard it and couldn’t listen to the Liar in-Chief, but here they are…

With tears in his eyes, President Obama pulled out all the stops in pushing his new executive orders on gun control this week.  A Washington Post headline exclaimed, “President Obama’s amazingly emotional speech on gun control.”  But the president also tried to appeal to people’s minds with a barrage of factual claims.

Unfortunately, the president’s remarks had a large number of errors.  Here are 11 of the false or misleading claims that the president made.

President Continues to Insist “We’re Not After Your Guns” During CNN Town Hall Meeting


Last night, President Barack Obama continued his campaign to build grassroots support for Executive Actions he says were designed to curb gun violence in America, not infringe on the Second Amendment right of gun owners. During the two-hour CNN Town Hall meeting, the President used humor (“I’ve been good for gun manufacturers”) and occasionally errant facts (criminals “buy” guns) and his oratorical abilities in an effort to minimize the impact his executive actions would have on law-abiding gun owners. Although Mr. Obama fielded both pointed and rambling questions from pro-gun audience members, the National Rifle Association, which Mr. Obama criticized for not attending despite being “headquartered right down the street” apparently refused to take part in the Town Hall meeting. “The National Rifle Association,” Mr. Obama said, “used to favor background checks. Now, they aren’t willing to even consider face-to-face conversation on the issue.”

USCCA Responds to President Obama’s Executive Order to Expand Gun Control

GW:  I watched the Tyrant in Chief live yesterday, as he continued his assault on my rights to own firearms without registering them.  And, that’s what he’s attempting to do – even though he doesn’t have the authority vested in his throne.  All I heard was we need bigger government and we need to register all firearms.  I couldn’t listen to the entire pathetic speech and had to tune out.

In a statement earlier today, President Barack Obama announced his plan to initiate a new executive order that includes but is not limited to expanding background checks for private gun sellers.

According to Fox News, the President’s actions “mark a renewed bid…to enact gun control measures with or without Congress.”

USCCA President and Founder Tim Schmidt notes that “President Obama’s anti-freedom, pro-socialism executive order—his blatant push for more gun control—is a direct response to calls from anti-gunners—who, by the way, do not comprise the majority of people in this country—to do ‘something’ about the perceived level of gun violence across the U.S.”

He insists, “We absolutely cannot stand for this gross overreach of power that directly and negatively affects millions of law-abiding men and women in this country.” Read more

California law allowing seizure of guns without notice begins Jan. 1

Gun control legislation going into effect in California tomorrow will allow authorities to seize a person’s weapons for 21 days, if a judge determines there is potential for violence. 

GW:  My take on this relates to the large number of liberal judges who would take away anyone’s guns regardless of the reason(s) to satisfy their own agenda and that of the misguided left-leaning crowd.  They are definitely out there – way out there, for that matter and some are chomping at the bit to flex their muscle.
