Black Lake sturgeon spearing season tradition continues

The Lake sturgeon is an ancient fish species that inhabits large river and lake systems in the Great Lakes Basin and elsewhere.

These monstrous fish can grow up to 7 feet long and weigh 200 pounds, providing Michigan hook-and-line anglers trying to catch them an extraordinary thrill.

They are the largest fish native to the Great Lakes, and because of habitat loss – mostly the loss of spawning habitat by the creation of dams – and overfishing in the past, the lake sturgeon is a threatened species in Michigan. Specific regulations limit sport fishing, and no commercial harvest is allowed.

Only at Black Lake in Cheboygan County can sport anglers use spears to harvest a sturgeon. There is a strict quota limiting total angler take and, individually, anglers can harvest only one sturgeon per season. Read more

Sportsmen’s Alliance, Maine Trappers Victorious in Lynx Lawsuit

On Wednesday, Feb. 15, U.S. District Judge Jon Levy issued his ruling in a lawsuit that sought to revoke the state of Maine’s Incidental Take Permit (ITP), which would open individual trappers to Endangered Species Act (ESA) violations. Judge Levy ruled the U.S. Fish and Wildlife Service’s use and application of ITPs were lawful and in keeping with the requirements of the ESA.

The ruling is a clear victory for the Sportsmen’s Alliance Foundation, trappers in Maine and the Maine Department of Inland Fish and Wildlife. In his ruling, Judge Levy found that the U.S. Fish and Wildlife Service’s “actions were in keeping with the requirements of the Endangered Species Act…the National Environmental Policy Act…and the Administrative Procedure Act…” Read more

Congress Acts on Bad Social Security Measure

By Jim Shepherd

After the Senate voted 57-43 yesterday to strike down a Social Security regulation that would have required the Social Security Administration to report anyone who received disability benefits and had a wide range of medical conditions – from serious mental issues to sleeping and eating disorders- mainstream headlines quickly read “Senate Restores Right of Mentally Ill to Purchase Guns”.

It’s a certain sign of just how far the chasm is between fact and objectivity when it comes to supposedly “unbiased” news reports. The measure wasn’t a great piece of legislation artfully crafted to address a glaring need in the existing system. It was a slap-dash piece of legislation. In fact, Sen. Charles Grassley of Iowa, said it was filled with “vague characteristics that do not fit into the federal mentally defective standard” . Those same “vague characteristics” would have lumped people with sleeping disorders into a group of considerably more serious mental issues that would have required the Social Security Administration to notify the FBI of those conditions- so they could be entered into the FBI’s NICS background check system.

In short, it would have guaranteed those people would be denied if they tried to purchase a gun if their conditions led them to have third-party involvement in the management of their affairs.

As Grassley said “If a specific individual is likely to be violent due to the nature of their mental illness, then the government should have to prove it.”
I know it’s not popular with anti-gun folks, but the idea of “innocent until proven guilty” is woven pretty tightly into our national fabric. Read more

SCI Urges Support for H.J. 69

Safari Club International (SCI) encourages all sportsmen and women to contactyour U.S. Representative today and voice your support for House Joint Resolution 69.

If approved, H.J. Res. 69 will allow Congress to reverse a final rule, adopted by the U.S. Fish and Wildlife Service (FWS), that prohibits and restricts legal forms of hunting on National Wildlife Refuges in Alaska.

This final FWS rule contradicts the Alaska Department of Fish and Game’s constitutional mandate to manage the state’s wildlife resources for sustained yield, which is affirmed in the Alaska Statehood Act, the Alaska National Interests Land Conservation Act, and the National Wildlife Refuge System Improvement Act. In short, the FWS regulation that H.J. Res. 69 will nullify is one that interferes with the State of Alaska’s ability to provide adequate wildlife for the state’s hunters.

With your help, H.J. Res. 69 will give Congress the opportunity to reverse this harmful FWS regulation adopted during the last months of the Obama Administration. It is imperative that you contact your Representative today and urge him/her to vote Yes on H.J. Res. 69. You must act NOW, as this Resolution is anticipated to be voted on the House floor today Thursday, February 16. Read more

Federal Court Overturns ScentLok Decision

ScentBlocker has successfully overturned the original jury award in the case ScentLok brought against it in 2014 claiming false advertising. The case took an abrupt turn on January 30, 2017 when United States District Judge Gordon J. Quist issued the court’s Opinion granting ScentBlocker’s motion for judgement as a matter of law and vacating the original jury’s finding of liability in the case.

In the Opinion, the Court states “ALS (ScentLok) argues…this case essentially involved a “bait and switch”…regarding the sale of ScentBlocker’s Trinity products. According to the Court “These arguments fail.” The Opinion went on to state: “Noticeably absent from this case…was any testimony or evidence from the retailers. ALS presented no survey evidence, nor did any witness from Cabela’s, Gander Mountain, or Dick’s testify that they were deceived.” Read more
