Center for Biological Diversity, Others, Hiring Attorneys to Challenge Government Actions

Animal extremist groups have recently announced their decisions to hire additional attorneys to challenge predicted federal government regulations and actions regarding energy, the environment and endangered species. The Center for Biological Diversity (CBD) and Earthjustice, two groups who appear opposite of the Sportsmen’s Alliance Foundation on many lawsuits, are hiring six and eight additional attorneys.

“While the specifics of their lawsuits are still unclear, one thing is certain: these animal extremists are committed to dismantling sportsmen’s rights in our country, and they have the funding to pursue as much,” said Dr. Todd Adkins, Senior Vice President at the Sportsmen’s Alliance. “Years and years of sue-and-settle schemes have lined the coffers of ideologues, and they have no shame in utilizing those funds to pursue silly, superfluous lawsuits without legal or scientific backing.”

The new presidential administration has brought a wave of new administrative actions – many of which have created anxiety and ideological roadblocks for animal extremists. But these organizations are no strangers to suing the federal government. CBD sued the previous Trump administration more than 280 times, while Earthjustice took the administration to court over 200 times. These numbers are staggering – especially when you consider the lunacy of many of their arguments – but not surprising.

CBD has over 70 in-house attorneys, and Earthjustice employs at least 200. Our most common animal extremist foes collectively employ over 350 in-house lawyers. When you consider SAF’s Office of Litigation Counsel, combined with our closest in-house litigation partners, hunters, anglers and trappers are outnumbered 70:1 with respect to legal representation.

This number highlights the importance of the work the Sportsmen’s Alliance Foundation is doing. Very few conservation organizations are willing to go to court to defend sportsmen. Not only do we seek out opportunities to uphold our rights in court, but we do it with an in-house team.

“We’ve been litigating against CBD, Earthjustice and other animal extremists for years, and their tactics have changed very little,” said Michael Jean, Litigation Counsel at the Sportsmen’s Alliance Foundation. “But they’re willing to spend exorbitant amounts of money to pursue their ideologies. Fortunately, we’ve been very effective and efficient at defending against these attacks.”

Michigan DNR set to conduct community-based northern Lower Peninsula wolf survey

The Michigan Department of Natural Resources Wildlife Division is seeking the public’s help in conducting a community-based northern Lower Peninsula survey to detect any potential presence of gray wolves.

The survey, which will rely heavily on reports from the public of wolf sightings and other potential evidence, will take place from Feb. 17 through March 10.

“Our efforts will be concentrated in the norther Lower Peninsula which does contain some limited suitable habitat that could potentially support a small wolf population,” said Brian Roell, Michigan Department of Natural Resources large carnivore specialist in Marquette.

Sightings, photos and other signs of wolf presence can be reported by the public to the

DNR’s Eyes in the Field webpage. Reports including photos or other evidence will be reviewed and a reply will be sent from DNR Wildlife Division staffers.

Victory in SAF-Funded Case Challenging Illinois FOID Mandate

A Circuit Court judge in Illinois has struck down the state’s requirement to have a Firearm Owner Identification (FOID) card to possess a firearm in the home for personal protection in a case supported by the Second Amendment Foundation and Illinois State Rifle Association.

The case is known as State of Illinois v. Vivian Claudine Brown. Ms. Brown is represented by attorney David Sigale of Lombard, Ill.

In his 15-page decision, White County Resident Circuit Judge T. Scott Webb observed, “The Defendant’s possession of a .22 caliber rifle within the confines of her home, even without a valid FOID card falls squarely within the protections afforded her by the Second Amendment.

“If an intruder had entered Ms. Brown’s home,” Judge Webb added, “and threatened violence towards her and, God forbid, she was forced to use that .22 rifle to defend herself, she would have committed a class A misdemeanor carrying with it a possible penalty of up to 364 days in the county jail. She could claim self-defense, but that does not change the fact that she possessed a firearm without a valid FOID Card. Such an outcome is asinine especially in this great nation that so cherishes the right to be secure and defend oneself within the home.”

“This is an important ruling in a case that has been up and down the Illinois judicial ladder a couple of times already,” noted SAF founder and Executive Vice President Alan M. Gottlieb. “We expect the state to appeal again, which could put the case right back before the Illinois Supreme Court for the third time, and we are confident we will win. It’s hard to see how the Illinois Supreme Court avoids the constitutional issue, as they have done on the previous two visits.”

“Today’s decision reflects a correct application of Supreme Court precedent to unconstitutional restrictions on the rights to keep and bear arms,” said SAF Executive Director Adam Kraut. “Illinois’ FOID card poses an untenable barrier to the exercise of Second Amendment rights in one’s home as the court correctly identified. Determining the FOID card to be an unconstitutional obstacle to firearms ownership and possession in one’s home was the only logical result.”
